If the driver involved in an accident is uninsured, they may choose not to stop, or pretend to pull over and then speed off before you can obtain their details. This is unfortunately a regular occurrence in England & Wales.
This leaves you, the injured party, unable to pursue a normal accident claim as there is no-one to claim against.
If the person does stop, how do you know if they have insurance or not?
Sometimes, the person might be honest and admit it to you, but it is always best to check yourself on www.askmid.com by searching for the registration number. It is recommended you do this at the scene as long as it is safe to do so.
Being injured is upsetting enough but not being able to identify the person responsible, or finding out that they do not have insurance, is likely to have amplified your emotions. Fortunately, there is a system in place to protect you. If you are involved in an accident with an uninsured or unidentifiable driver, your claim for compensation will be made through the MIB.
The Motor Insurers’ Bureau (MIB) is an organisation founded with the intent of dealing with compensation for accidents involving uninsured or untraced drivers. Every insurer providing compulsory motor insurance in the UK is obligated to have an agreement with the MIB as outlined in the Road Traffic Act 1988.
If the responsible party for a road accident is formally identified, and shown not to be covered by a valid insurance policy, the MIB may step in and deal with the compensation claim against an uninsured driver for the victim. They may also oversee claims against untraced drivers, or for accidents involving drivers covered by a foreign insurance company.
Claims can include damages to the vehicle, such as the costs to repair or replace it when the claimant is not comprehensively insured, property damage, medical costs, and any other losses occurred because of the accident.
The MIB is funded by mandatory contributions from all UK motor insurers, and untraced or uninsured driver compensation claims cost law-abiding drivers an estimated £30 a year in car insurance premiums.
The Motor Insurers Bureau (MIB) estimates that up to 10% of all vehicles on our roads are uninsured vehicles. That means if you are hit by an uninsured driver, there is no policy in place to cover your personal injury and other losses.
Fortunately, the MIB has a scheme in place for Uninsured Drivers.
In some situations, the driver may not have insurance to drive that vehicle, but the owner of the car does. As long as somebody is insured to drive the car there is a good chance the innocent victim will be able to claim compensation from that insurer.
However, it may take an experienced professional to uncover the truth of the matter and get the compensation you are entitled to.
