Head Injury Due to Falling Mortar

In June 2017 our client was walking his two daughters to school.  Whilst walking past a terrace property on Ernest Street, Rhyl a piece of mortar fell from a property chimney and hit him on the top of his head. The incident was witnessed by a number of other pedestrians who provided their details to the Claimant. As a result, the claimant attended hospital and CT scans showed a mild concussive injury.

It transpired the property was undergoing remedial work/refurbishment and had been so for some time.  The chimney had a tarpaulin wrapping which was in a state of disrepair.

We received instructions in relation to this matter in July 2017 and thereafter commenced proceedings against the owners of the 2 properties either side of the chimney. Liability was denied by both of these owners, the first denying ownership of the chimney and the second stating that they had delegated responsibility to a construction company. In light of these denials, we commenced a case against the construction company. This company stated that the work had been subcontracted to another tradesman. Following the commencement of a claim against this individual liability was also denied.

Nevertheless, we thereafter obtained our client’s medical records and instructed a medical expert to prepare a report on our client’s injuries. The medical report confirms the mild head injury and the subsequent headaches which lasted for 3 months.

We issued court proceedings on in October 2019 and a trial date was subsequently listed in August 2020.

Fortunately, 3 of the Defendants agreed to split liability equally between them and the case settled for £2000.00.
