Eye Injury at Work Compensation Claim North Wales

PSR Solicitors of Rhyl have successfully obtained over £28,000.00 for our client who suffered a serious eye injury whilst at work.

Our client was employed as a production technician at a St Asaph firm manufacturing medical equipment. On the 29th September 2014 our client was completing a final clean of a periscope; he was cutting excessive adhesive around the glass away using a surgical scalpel.  Whilst doing so the tip of the scalpel snapped and entered his right eye. Our client immediately rinsed his eye and was then taken to hospital by his colleague. Regrettably, the company had not completed any adequate assessment for the need for Personal Protective Equipment and no goggles had been provided.  In addition, no training had been provided.

Following the accident, the company was investigated by the HSE and fortunately, the health and safety were dramatically improved thereafter.

As a result of the accident our client suffered a laceration and subsequent scarring to his eye and had to take nearly 6 months off work. However, the Claimant was paid company sick pay and therefore suffered no loss of earnings.

We received instructions in relation to this matter in February 2017 and submitted the claim to the Defendants immediately.  A Claimant has 3 years from the date of the accident to either settle their claim or issue Court proceedings to protect their position, otherwise, they are statutorily barred.

Liability was admitted by the Defendants.  We thereafter obtained our client’s medical records and instructed a medical expert to prepare a report on our client’s injuries.  Following receipt of the medical report, further clarification from the expert was required and as such, we returned to the expert.

Given the Limitation issue, we issued court proceedings prior to the limitation expiry in September 2017. Thereafter a stay was obtained to allow us to continue collating the necessary evidence to prove the Claimant’s case.

We engaged the serviced of a barrister to prepare advice as to the quantum in this matter given the severity of the injury and potential value.

Once medical evidence and financial losses evidence had been finalised, we applied to lift the Court stay and commenced settlement negotiations with the Defendants in October 2018.
