With the Divorce, Dissolution and Separation Act 2020, the Government has implemented reforms to divorce law to bring about a new No Fault Divorce system.
The bill has been supported by a large number of family lawyers. It removes the acrimonious and adversarial system we previously had wherein to obtain a divorce one of the parties had to blame the other or, alternatively, wait a number of years.
Where couples have reached a mutual decision to separate, the Act also introduces a new option, allowing couples to apply for a divorce jointly.
The aim is to make the process of divorce, separation or civil partnership dissolution less traumatic.
Under the reforms, people are now able to seek a divorce without having to blame their spouse.
Previously, there was only one ground for divorce in England and Wales, which is that the marriage has broken down irretrievably, and this had to be established by proving one of five specific scenarios.
A judge would have had to consider the facts and evidence provided in order to accept a divorce petition, and could reject the petition if these were not deemed sufficient to support it.
Since the new 'no fault divorce' rules came into effect in April 2022, there is no longer a need to prove any of the old acrimonious grounds for divorce.

There has been some opposition to the reforms among some government backbenchers and religious groups. This was mainly based on concerns that changing the legislation would make divorce too easy, undermining the bond of marriage.

No Fault divorce effectively ended the blame game and reduced acrimony in the divorce. The hope is that this will encourage a conciliatory approach which benefits all parties involved. The previous law simply ignored the emotional impact animosity between separating parents may have on the children.
With the introduction of No Fault divorce proceedings, separating couples are now able to apply for a divorce or dissolution without having to make accusations about their partner’s conduct, nor face long periods of separation before the marriage can be legally ended. The changes introduced by the Divorce, Dissolution and Separation Act 2020 have not fundamentally impacted the role of divorce lawyers.
