PSR Solicitors recently concluded a case in which our client, a child and protected party, was injured whilst at a Denbighshire college. Specifically, our client was a day student with respite at a Denbighshire College (as she has both physical and learning disabilities).

In June 2018 our client was standing with her carer in a doorway leading from the main hall to the canteen area. She was making her way to the main hall for lunch. Without warning, another student ran along the corridor with his support worker alongside him.

This student regrettably proceeded to run straight into our client, resulting in her being knocked forcefully backwards forcefully into the wall and falling to her left and onto the floor. As a result of the collision the Claimant suffered soft tissue injuries to arm and back along with an aggravation to her psychological status.

We received instructions in relation to this matter in July 2018 and submitted the claim to the Defendants via their insurers. The Claim was submitted in accordance with Protocol via the online Portal. Liability was admitted subject to causation by the Defendants in December 2018. We thereafter obtained our client’s medical records and instructed both an orthopaedic and psychological medical expert to prepare reports on our client’s injuries.

Following receipt of the medical report we instructed a barrister to prepare an advice as to the quantum in this matter, given the Claimant’s age and status. We proceeded to negotiate settlement and settlement was achieved out of court in the sum £7,250. This sum was entirely made up of general damages (damages for pain, suffering and loss of amenity).

An approval hearing was listed at Prestatyn County Court and was heard in October 2021. The settlement was approved by the Court and the matter finalised. As a result of our client employing our specialist services she obtained the best possible outcome; she received a personable service and a very generous compensation award.
