Injury Compensation for Prestatyn Pedestrian

PSR Solicitors recently concluded a serious injury compensation claim for a 62 year old disabled single male based in Dyserth, Denbighshire. Our client was in Prestatyn having attended a dental appointment and was waiting at the Prestatyn Bus Station.

Whilst standing in the pedestrian zone, a third party vehicle reversed at speed into collision with our client. It transpired that this vehicle was being driven by an 82 year old male who lost control of the vehicle. As a result of the collision our client was thrown over a small brick wall.

Our client suffered multiple severe injuries, including a fractured shoulder, fractured lumbar, broken leg and chipped teeth along with multiple soft tissue injuries and psychological injury. The Claimant was attended to by paramedics at the scene and was admitted to Glan Clwyd hospital for several weeks.

The matter was reported to the North Wales Police and the police undertook an investigation into the circumstances, however no action was taken against the driver. The driver did however surrender his licence as a result of the collision.

As a result of the accident the Claimant, who was already disabled, became a recluse and rarely left his home. He was aided by a kind neighbour who would help with his shopping and cleaning. The Claimant was not in employment prior to the accident, however lived a more outgoing lifestyle.

Upon taking instructions PSR Solicitors commenced a claim against the Defendant via his insurance company. Liability was swiftly admitted. We proceeded to instruct various medical experts including an orthopaedic expert, a dental expert and a psychological expert, to produce the necessary medicolegal reports to substantiate the claim. We thereafter collated the evidence relating to financial losses, including a gratuitous care claim and home adaptation.

Once medical evidence was finalised we disclosed the same to the Defendants, however no reasonable offers to settle were received. We issued the claim in the court in May 2017 and the matter was listed for trial for 3 days in November 2018. In the lead up to trial the Defendant’s obtained their own medical expert evidence and there was a discussion between orthopaedic experts to comment on the injuries suffered. Prior to trial settlement was achieved in the global sum of £85,000.00.

Although liability in this case was straightforward, the injuries were severe and long standing in nature and therefore medical evidence complex. Given that the Claimant was unemployed prior to the accident and had not worked for many years, no future loss of earnings claim was necessary; had it been needed the case would have potentially been of even greater value.
