Our client was employed as a Class 1 Waste Tanker Driver. In November 2015 our client was in attendance at a waste collection depot in London. He had finished loading the vehicle with waste and was in the process of securing a length of piping back on the vehicle.  In the process of completing this task, the heel of his right boot got stuck in a defective metal grid causing him to lose balance, turn his ankle and fall over the pipe onto his right shoulder.  

We received instructions in relation to this matter in June 2016 and duly submitted the claim to the defendants. The defendant initially denied liability. Nonetheless, we deemed there to be sufficient prospects of success and therefore pursued the matter further, instructing medical experts to examine our client and provide a detailed medical report.

We issued the matter in court in August 2018 and the matter was listed for trial in July 2019. The trial was vacated before reaching court when the defendant admitted liability on receipt of the claimant’s evidence, presumably realising that the Claimant’s case would succeed at trial.
